By accessing this website and placing an order, you agree to be legally bound by these Terms & Conditions under the laws of the State of Texas.

1. Governing Law & Venue (Texas Clause)

These Terms shall be governed by and construed in accordance with the laws of the State of Texas.

Any dispute, claim, or legal proceeding arising from the use of this website or purchase of products shall be brought exclusively in the state or county courts located in:

Dallas, Texas

Customer consents to personal jurisdiction and venue in those courts.

2. Binding Agreement

By placing an order, you confirm that you:

• Are at least 18 years of age. Have legal authority to enter into binding contracts. Agree to these policies in full.

3. Custom-Made Goods – Texas “No Return” Protection

Under Texas law, customized goods are generally not eligible for return once produced.

All products sold by Being You Designs and Prints are custom-made and non-resalable. Therefore:

ALL SALES ARE FINAL.

Orders may not be canceled once production begins.

4. Design Approval & Customer Responsibility

Approval of a digital proof constitutes full acceptance of:

• Spelling, Artwork, Placement, Sizing, Color selection

Customer assumes full responsibility for approved content.

5. Right to Refuse Service 

We reserve the unconditional right to refuse service or cancel an order if:

• The design violates federal or Texas law, The content infringes copyright or trademark, The request includes hate speech, obscenity, or harassment, The customer engages in threatening or abusive conduc

We may cancel accounts or block further purchases at our sole discretion.

6. Intellectual Property & Indemnification

Customer represents that they own or have authorization to use submitted artwork.

Customer agrees to indemnify and hold harmless Being You Designs and Prints against:

• Copyright claims, Trademark disputes, Legal fees, Damages or settlements
  We do not verify ownership of submitted content.

7. Chargeback & Fraud Protection

Under Texas law, fraudulent chargebacks may constitute theft of services.

By placing an order, you agree to contact us first to resolve any issue before initiating a payment dispute.

If a chargeback is filed fraudulently, we reserve the right to:

• Submit full documentation to financial institutions, Report the incident, Pursue recovery of funds and associated fees

8. Shipping & Risk of Loss

In accordance with Texas Uniform Commercial Code (UCC):

Risk of loss transfers to the customer once the product is delivered to the shipping carrier.

We are not responsible for:

• Carrier delays, Lost or stolen packages, Delivery errors by third-party shipping providers

9. Limitation of Liability

To the maximum extent permitted under Texas law:

Being You Designs & Prints shall not be liable for:

• Indirect damages, Consequential damages, Event losses, Lost profits, Emotional distress claims

Total liability shall not exceed the purchase price paid for the specific product.

10. Force Majeure

We are not liable for delays or failure to perform due to causes beyond our control, including but not limited to:

• Natural disasters, Severe weather, Power outages, Supply chain disruptions, Government actions

11. Severability

If any provision of these Terms is deemed unenforceable under Texas law, the remaining provisions shall remain in full force and effect.

Due to the customized nature of our goods:

NO REFUNDS, NO RETURNS, NO EXCHANGES.

Claims for damaged or incorrect items must be submitted within 48 hours of delivery with clear photographic documentation.

Failure to notify within this period constitutes acceptance of the product.

We collect personal information solely for:

We do not sell customer data.

Payment information is processed securely through third-party payment providers.

Information may be disclosed if required by Texas or federal law.
